Do You Need a Permit? The Short Answer: Usually Yes.
Most significant outdoor improvements in Hamilton, Burlington, Oakville, and Ancaster require one or more municipal permits before construction begins. Skipping the permit process can result in stop-work orders, mandatory demolition, fines, and complications when selling your home.

Inground Pool Permits
Inground pools are among the most heavily regulated outdoor projects in Ontario. Every municipality in our service area — Hamilton, Burlington, Oakville, Ancaster, Flamborough, and Campbellville — requires a building permit before excavation begins.
What is required for an inground pool permit:
A site plan showing the pool location, setbacks from property lines, and distance from the house. Structural drawings for the pool shell, deck, and any retaining walls. Electrical permit for pool lighting, pump, and bonding. Fence permit — Ontario law (O. Reg. 565) requires a 1.2-metre (4-foot) barrier around all pools, and many municipalities require 1.5 metres (5 feet). Zoning compliance confirming setbacks (typically 1.5–2.4 metres from property lines depending on municipality).

Retaining Wall Permits
Retaining walls are required when you need to manage grade changes, prevent erosion, or create level outdoor living areas. Permit requirements vary by wall height and proximity to property lines.
When a permit is required:
In Hamilton, Burlington, and Oakville, retaining walls over 0.6 metres (2 feet) in height generally require a building permit. Walls over 1.2 metres (4 feet) require engineered drawings stamped by a licensed Professional Engineer. Walls near property lines, utility easements, or slopes require additional review. Tiered walls (multiple shorter walls in sequence) are evaluated as a single wall system.

Outdoor Kitchen & Patio Permits
Outdoor kitchens and covered patios may require building permits depending on their size, structure, and whether they include gas or electrical connections.
Outdoor kitchen permit requirements:
Gas line extensions for built-in grills and fire features require a gas permit and inspection by a licensed gas fitter. Electrical work (outlets, lighting, appliances) requires an electrical permit. Covered structures (pergolas, pavilions, shade structures) over 10 square metres require a building permit in most Ontario municipalities. Permanent structures attached to the home are treated as additions and require full building permits.
Patio and hardscape permits:
Ground-level patios generally do not require permits. Raised decks and platforms over 0.6 metres above grade require a building permit. Any patio that changes drainage patterns or is near a property line may require a grading permit.

Regional Permit Requirements at a Glance
City of Hamilton (including Ancaster, Flamborough, Dundas):
Building permits are issued by the City of Hamilton Building Division. Pool permits, retaining wall permits, and structure permits are all managed centrally. Ancaster residents should note that despite being part of the City of Hamilton, some projects near the Niagara Escarpment require additional review under the Niagara Escarpment Plan.
City of Burlington:
Burlington’s Building Department manages permits for pools, structures, and landscaping. Burlington has specific requirements for pools near the Lake Ontario shoreline and in flood-prone areas. Grading permits are commonly required for significant landscape changes.
Town of Oakville:
Oakville requires building permits for pools, structures over 10 square metres, and retaining walls over 0.6 metres. Oakville also has a Tree Protection By-law that may require a permit before removing trees during landscaping projects. Properties near Sixteen Mile Creek or other watercourses require Conservation Halton approval.
Conservation Authorities:
Projects near watercourses, wetlands, or the Niagara Escarpment may require approval from Conservation Halton or the Hamilton Conservation Authority in addition to municipal permits. Devine Image identifies all required approvals upfront so there are no surprises.
